Terms and Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern your use of the AutoFix Hub platform and related services. By creating an account and accepting these Terms, you enter into a binding Subscriber Agreement with AutoFix Hub (Pty) Ltd, registered under the laws of the Republic of South Africa.

2. Definitions

  • “Platform” means the AutoFix Hub garage management software and associated services.
  • “Subscriber” means the legal entity or individual that has registered for an account.
  • “User” means an individual authorised by the Subscriber to access the Platform.
  • “Service” means the cloud-based garage management solution provided by AutoFix Hub.
  • “Subscription” means the recurring payment plan selected by the Subscriber.

3. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

4. Subscription and Billing

Subscription fees are billed in advance on a monthly or annual basis, as selected during checkout. All fees are exclusive of VAT (15%), which will be added at the applicable rate. Payment is processed via PayFast. If payment is not received by the due date, access to the Platform may be suspended.

5. Trial Period

New Subscribers may be eligible for a free 30-day trial. During the trial, access is provided subject to these Terms. If you do not subscribe before the trial ends, access will be suspended. No credit card is required for the trial.

6. Service Level Agreement

Our service availability commitments and support response targets are set out in the Service Level Agreement.

7. Cancellation

You may cancel your Subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. Please refer to our Cancellation & Refund Policy for full details.

8. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of South African law.
  • Attempt to gain unauthorised access to any part of the Platform or its systems.
  • Interfere with or disrupt the integrity or performance of the Platform.
  • Use the Platform to store or transmit malicious code or malware.
  • Reverse-engineer, decompile, or disassemble any part of the Platform.

9. Data Processing

In providing the Service, AutoFix Hub may process personal information on behalf of the Subscriber. The terms governing such processing are set out in the Data Processing Agreement.

10. Limitation of Liability

To the maximum extent permitted by South African law, AutoFix Hub shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform. Our total aggregate liability shall not exceed the total Subscription fees paid by you in the 12 months preceding the claim.

11. Intellectual Property

The Platform, including all software, design, text, images, and trademarks, is the property of AutoFix Hub or its licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be submitted to the jurisdiction of the courts of Johannesburg.

13. Changes to Terms

We may amend these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
